true there is a petition for a special meeting to recall four directors...but the directors are directors until they're recalled...why should the three directors who want the recall have all the fun? or all the say?

Why would you say that 3 Directors want the recall?

To my knowledge at least 318 Unit Owners petitioned the Board for a Special Recall Meeting and not 3 Directors.

who's running the recall show? do you see 300 owners running after four directors?

no.

but you do see three directors snapping at the heels of four directors...

and while this is going on, guess who's voting to spend our money. All the directors.

maybe you don't know too much about politics?

We're in the process of impeaching our association president (2/3 of residents have signed a petition). If not all 2/3 can attend a meeting, is the petition enough? What else should we consider?
I would have someone who's friendly with the President tell him/her where things stand, and ask him to step down for the good of the condo association. If you can think of a role for the president, e.g., chairing the landscaping committee, it might make things easier. If he steps down, let bygones be bygones and thank him for his/her years of service.
If I did call a meeting to impeach the president, I would ask everyone who can't attend the meeting to submit a proxy form for someone else to act on their behalf at the meeting.
I would also make sure that I had 2/3rds as a percent of ownership. In many associations, percent of ownership is determined by such things as square footage. For instance, someone who owns a studio unit would own a smaller percentage of the association than someone who owned a three bedroom unit. (Chances are, the percent of ownership for all units appears on the deed.)
Lastly, what we've presented is common sense advice. It's always best to discuss a matter like this with an attorney. If you feel the president will fight you tooth and nail, then you should consider that.

Great job again Ellinger! Some of the 2 + 3 bedroom apartments are now selling for less than some of the one-bedroom apartments. Keep raising the maintenance and the value will go down to nothing. Do the owners a big favor and step down. You and Norget have destroyed this place.

the Recall Vote Outcome must be verifiable that is owners who vote must be checked off against a roster of owners of record who are also in "Good Standing"
Is Steven Braitman an owner in good standing or is he behind and still bouncing checks to the GTCA?

This post is about the practice by the former Video Committee that ran Ch.26. We used to have the channel's cameraman Hank tape the counting of the ballots for any election. But then it was decided that the powers that be would not like to have such a perminent record.

Ken Williams is our former board council.

At the annual meeting when the petitioners called for a vote to remove Ellinger, Bolasco, Haase and Blank, Ellinger refused to step down or call for the vote as he is required to under the bylaws and master deed. He explained that it would not be fair to the owners who didn't know of the recall and did not attend the meeting. He said if the owners knew the recall was on the agenda they might have attended the meeting.

Instead of suing the GTCA, the petitioners decided to get enough signatures to call a special meeting so all owners would know what is on the agenda. Now Ellinger’s supporters are saying that it would be unfair to have the remaining directors decide who the replacements are for the recalled directors if the recall is successful. Now Ellinger doesn’t want to have the special meeting. He wants the petitioners to cancel the recall if he and Blank resign. He wants them to ignore the bylaws and master deed as he did at the annual meeting. He asked for Buckalew’s opinion. (Buckalew had an instant opinion for this! unlike when Braitman asked him for an opinion about water damage responsibility, Buckalew had to “write a memo” and do some research) He explained that the Board could make a better business judgment to not call the meeting as required by the governing documents if they decide. He then cautioned that one or more of the owners could sue the GTCA. He explained that if all four directors didn’t resign and the Board refused to call the meeting and the owners sue, the chances of the owners being successful were very good but if two resigned and only two remained, if the owners sue they may not be as successful. I think he said the judge might look at it differently if two Board members had resigned.

In my opinion, Buckalew’s opinion was a planned and staged attempt to legitimize Ellinger’s suggestion to ignore the governing documents AGAIN. I believe what he said is basically giving the “ok” to the Board to not call the meeting now that Ellinger and Blank plan to resign. This is how I see it and remember it. Correct me if I’m wrong. I will be putting up the video in a few days for the owners that can’t get channel 26.
