Mr. Hefler -
I am asking again, for the third time, that you resign your position on the board. Please do this for the betterment of me, and my neighbors at the Galaxy.
More than a week has passed since I sent the attached Email. Although I continue to wait for your response, it appears that none will be received. Certainly, the timeliness of your reply, if it comes, is suspect.
There are two parts of my mail that I want to review - your attendance at working sessions and your offer to address energy conservation.
First, I had an opportunity to speak with a board member just a few days ago. At your suggestion, I did ask that person to comment on your attendance at working sessions, and he confirmed what my sources have shared for many weeks. At first, that person attempted to support you, and your absences, by indicating that you were briefed on all that you missed. I counseled that individual to know that interaction is key to a working session, and briefings cannot possibly allow anyone to be positioned to vote for the improvements we need. By that person's lack of response, and body language, I knew there was an agreement. Again, these are critical times here, and all directors must participate in those working sessions. If you are unable to do so, for personal reasons, or conflicts in your business schedule, you must step down.
Secondly, it was you who volunteered to provide information about energy conservation, as indicated in your mail. I am concerned about that topic, and I do appreciate your taking an interest in it, but I didn't bring it up. You did. In my response to that, I asked several questions, made a few observations, and even made a recommendation. Your lack of response to those points only tells me that either you have no knowledge, or are unwilling to share what you have learned. For this gaping hole in your desire to communicate, i ask again that you resign.
Please think about the other residents in our tower. We are all looking for all the board members to do the right thing. You were supported enough to win an election, but that gives you little right to have a dismal record of performance.
This time around, I am going to forward my mail to other board members, including Mr. Lerner. Hopefully, he will assess my points of deep concern with you, and support my recommendation that you resign. If he does not, I would hope that he would assume his leadership position and lead a charge to dismiss you.
Further, to gain support of my wishes, and to help make this a better place to live for my neighbors, you will see these communications on Galaxy Facts.
It will not be an anonymous post.

Thank you for taking time out to call me yesterday. It is appreciated whenever any elected board person reaches out to discuss various issues.
A key component of our discussion centered around Jon Hefler, and his absentee record at far too many working sessions. I continue to believe that personal participation at these work sessions will contribute, in time, to a better Galaxy.
Earlier today, I learned that Mr. Hefler missed two meetings this week. This adds to my desire to have him resign. It's incredulous that with my several Email exchanges with him, and my posts on Galaxy Facts, and my discussion with you, that he would elect to miss last night's session. If for nothing else, he would have elected to attend to take some of the heat off you.
Running the Galaxy, in many ways, is like running a business. There are financial matters, service issues, and people who are in leadership roles. If I was a President of my business, Mr. Hefler's record of participation would have prompted me to put him on notice, leading to his dismissal. Any employee, in any business, would have at the least reacted to this recent dialogue, and made it their absolute business to attend these sessions.
I do not want to attack Mr. Hefler. I've learned that he is an Ivy League graduate, he appears to be intelligent, and he is a family man. Although I've never met him, these qualifications should position him as a bona fide member of the board. His refusal to attend these work sessions eradicates any of his characteristics and abilities.
Slava, you are the leader of the board of directors. Allow me to suggest that you not attempt to justify his importance. Doing so, will only continue to alienate yourself from people who live here. I am confident that most people would applaud your decision to terminate Mr. Hefler, which in turn, might eliminate some of the attacks on you.
Do the right thing for the people who are your neighbors. Consult with Mr. Hefler, and demonstrate solid leadership qualities by asking for his resignation.
It's the right thing to do.

An open letter to my neighbors, Fini Strumza and Richard Miller -
There is a mounting campaign to remove you from the board. Whether this happens or not is yet to be determined.
Both of you are my neighbors in Tower 3, and when I see you, it is apparent on your faces and body language that the stress of your responsibilities is taking its toll.
I have always respected people who fight hard for what they believe in, but at this point you need to do something for me, your neighbors in our tower, and all the owners at our complex. This is the time to make a statement that will appeal to your neighbors, rather than disagree with them. This is the time to recommend and vote on the removal of Jonathan Hefler.
Mr. Hefler, who I have nothing against personally, is embarrassing you. He disrespects you when he declines to participate in working sessions. He, unlike both of you, has declined, in writing, to engage me in any discussions. He made that proclamation after only three Emails I sent to him, over a period of about a month. Actions like that are not helpful to any of us. I have tried to present myself in a factual, professional fashion, and Mr. Hefler will not have any of that. Both of you have not cut me off, nor has Slava Lerner, so you have to question his desire to support his neighbors. It confounds me that the three of you have proactively reached out to me, and he, after my reaching out to him, has responded with false assumptions, empty rhetoric and a proverbial closed fist.
Both of you, I know, from time to time, work beyond normal hours on various tasks. His absences make you look like fools to the people who have an interest in making the Galaxy a better place. He is taking advantage of you, and as you continue to defend him, it detracts from your wisdom and strength. It make you appear weak as you allow this to continue.
Please do the right thing for yourselves. Listen to your community, and do something that could make us proud of you.
Letting Mr. Hefler use you for his conveniences will only add to the growing wave of people who want to remove you from the board. Doing so might not save your positions, but at least its a good start.

Good point, Mr. Gettelson. I wish I could say that any director had much influence but we are clearly there to be "rubber stamps." Those of us who express opinions that are at odds with opinions expressed by Mr. Lerner are subjected to various forms of harrassment--by other directors or committee chairs.
Here's an email I received from Jon Hefler when I disagreed with the board majority over the removal of Mr. Van Bergen:
Oh Barbara,
If only anyone else saw "it" how you see "it", the world might be a better (if slightly more paranoid?) place. In fact, the rest of us who are forced to labor without the benefit of that secret special Law-Business-Ethics-Management-Finance joint degree (that only you posses) might consider extending you the "courtesy" you so desperately crave as soon as you agree to stop betraying the Board's trust on a routine basis. I understand the difficulty of this decision though: Those adoring fans on the internet who yearn for those pithy half-truths denigrating your fellow directors OR the respect of your neighbors, the community and FINALLY, after all your time on the BOD, your fellow directors.
I know, I know....I have a different point of view than you do so this email is being forwarded to your lawyer, five congressman, eight senators, Supreme Court Nominee Sotomayor and, of course, the Queen of England.
God save the Queen, Barbara. God save the Queen.

This is Mr. Hefler's main contribution to the work of the board--he writes quite a few emails like this one.
These emails don't bother me--I simply send a package of these things to my attorney every week--but I do wish Mr. Hefler would do something positive.
